1. Agreement to Terms

By accessing or using ListingRocket ("us", "we", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services. These provisions apply to users globally, including those residing in North America (US and Canada), the United Kingdom, the European Economic Area (EEA), and Australia.

2. Description of Service

ListingRocket provides AI-powered real estate marketing tools, including listing descriptions, social media post generation, image collages, TikTok-style property videos, and single-property microsites. Services are provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without notice.

3. User Accounts

When creating an account, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activities under your account. You agree not to disclose your password to any third party and must notify us immediately upon becoming aware of any security breach or unauthorized use.

4. Payments, Credits, and Subscriptions

ListingRocket operates on a token/credit-based system. Credits may be purchased as one-time token packs or through monthly subscription plans.

• Token Packs: One-time purchases. Tokens expire 365 days from the date of purchase. Unused tokens are non-refundable unless required by local law (such as the 14-day cooling-off period under UK/EU consumer law, provided you have not yet used the credits).
• Subscriptions: Monthly plans renew automatically on the same day each month. You may cancel at any time through your dashboard; cancellation takes effect at the end of the current billing period. Tokens allocated by a subscription follow the same 365-day expiry from allocation date.
• Taxes: Applicable sales taxes (e.g., Canadian HST/GST/PST) are calculated and added at checkout based on your billing address.
• Refunds: If an AI generation fails, your token is automatically refunded. We do not offer partial refunds for unused tokens. We reserve the right to change pricing, credit packages, and subscription structures at any time.

5. Intellectual Property Rights

Your Content: You retain all ownership rights to the property data, photographs, and media you upload ("User Content"). By uploading User Content, you grant ListingRocket a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing and operating the service. You warrant that you have the right and explicit permission from property owners (where required) to upload such images.

Generated Content: Subject to your compliance with these Terms and payment of applicable fees, we assign to you all rights, title, and interest in the marketing materials generated by our AI services based on your specific input. Note that AI-generated content may not be unique — similar inputs from different users may produce similar outputs.

6. AI Generation Disclaimer & Fair Housing Compliance

ListingRocket utilizes third-party artificial intelligence services (including Google Gemini, Groq, and OpenRouter) to generate property descriptions and marketing materials. While we strive for accuracy, AI-generated content may occasionally produce errors, inaccuracies, or content that does not align with your local real estate regulations.

You are solely responsible for reviewing, editing, and verifying all AI-generated content before publication. Content should be reviewed by a qualified real estate professional where appropriate. You must ensure that the final published content complies with all applicable real estate advertising laws, including but not limited to the US Fair Housing Act, Canadian human rights legislation, UK Consumer Protection from Unfair Trading Regulations, and Australian Consumer Law. We are not liable for regulatory violations arising from unreviewed AI-generated content.

7. Acceptable Use

You agree not to use the service to:

• Upload copyrighted media for which you do not have permission.
• Generate content that is illegal, harmful, deceptive, or fraudulent.
• Violate any local, state, national, or international laws or regulations.
• Attempt to reverse-engineer, decompile, or otherwise extract the source code or underlying AI prompts of our platform.
• Use automated scripts or scrapers to access the service without our permission.

8. Data Retention

Generated marketing kits are retained for 30 days from creation, after which they are automatically deleted. Videos are retained for 30 days. Uploaded photos are retained with their associated listing. Token batches expire 365 days from purchase. Account data is retained until you request deletion. 9. Social Media Integration

When you connect your Instagram or Facebook accounts, we store encrypted access tokens to enable posting on your behalf. We post only when you explicitly request it. You may disconnect your social accounts at any time through your dashboard settings. We are not responsible for platform-specific content policies, post removal, or account actions taken by third-party social media platforms.

11. Regional Provisions

• Canada: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. PIPEDA applies to the collection and use of personal information. Any disputes shall be resolved in the courts of Ontario, Canada.
• United Kingdom & European Union: If you are a consumer residing in the UK or EU, these terms do not limit your statutory rights. Liability for death or personal injury caused by our negligence, or for fraud, is not excluded.
• Australia: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits, modifies, or excludes those consumer guarantees.
• United States: These Terms contain a binding arbitration clause and class action waiver. ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS IN BINDING ARBITRATION. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

12. Termination

We may suspend or terminate your account if you violate these Terms of Service. You may delete your account at any time via Dashboard → Settings → Account. Upon deletion, all your data is permanently removed in accordance with our Privacy Policy.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall ListingRocket, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; and (iii) unauthorized access, use, or alteration of your transmissions or content.
